Huawei and ZTE may be forced to withdraw devices from sale in Germany after holders of video patents moved to enforce an injunction against the Chinese companies for infringing patents. MPEG LA, the patent pool for multiple companies involved in licensing the AVC/H.264 standard, said that two of its members have enforced verdicts of injunction in the district court of Duesseldorf against Huawei Deutschland and ZTE Deutschland.
The group said Huawei and ZTE could avoid the injunctions by taking a licence to the AVC patents. In both cases the Court of Appeals has dismissed Huawei’s and ZTE’s requests for a stay of the enforcement while the cases are under appeal.
As a result, Huawei and ZTE must cease and desist from offering in Germany AVC/H.264 compliant devices such as smartphones and tablets that use the enforced patents. In addition, all such products in their possession or the possession of third parties must be recalled and destroyed, according to MPEG LA.
